There is no such thing as a "Texas floodplain permit" issued by a state agency. Every floodplain development permit in Texas is issued locally — by a city or county floodplain administrator — and the rules that administrator enforces come from the National Flood Insurance Program (NFIP), not from Austin. That single fact trips up engineers who are used to a state DOT or state environmental agency running the show; on floodplain work in Texas, the local jurisdiction is the permitting authority, full stop.

What is a floodplain development permit, and why does Texas issue it locally?
A floodplain development permit authorizes construction, grading, fill placement, or other development within a FEMA-mapped Special Flood Hazard Area (SFHA). It exists because participation in the NFIP requires a community to adopt and enforce floodplain management regulations as a condition of its residents and property owners being eligible for federally backed flood insurance. Texas has no statewide building code enforcement mechanism in unincorporated areas and no state-level floodplain permitting agency — each NFIP-participating city and county adopts its own floodplain ordinance and appoints its own floodplain administrator to enforce it. The Texas Water Development Board (TWDB) supports NFIP participation and provides technical assistance statewide, but it does not issue development permits itself.
Does my site need a floodplain development permit?
If any part of the parcel falls within a FEMA-mapped SFHA — typically the areas shown as Zone A, AE, AH, AO, or similar on the effective Flood Insurance Rate Map (FIRM) — a floodplain development permit is required before you grade, fill, construct, or otherwise alter land within that zone. "Development" under NFIP regulations is defined broadly: it includes grading and fill placement, not just building construction, which is why site-civil engineers, not just architects, are squarely in scope for this permit.
What's the difference between the floodway and the flood fringe?
Within the SFHA, FEMA maps typically divide the flood hazard area into two zones with very different development rules:

The floodway is the more restrictive zone by design — it is the area FEMA has determined must remain clear to pass the base flood without pushing water levels higher onto neighboring property. The flood fringe still carries flood risk and still requires a permit and typically an elevation or floodproofing standard, but it is not held to the same no-rise standard as the floodway.
What is a no-rise certification, and when is it required?
A no-rise certification is an engineer-sealed analysis demonstrating that a proposed encroachment into the regulatory floodway will not cause any increase in the base flood elevation. It is generally required any time development — fill, grading, a structure, a bridge or culvert crossing — is proposed within the mapped floodway, because floodway encroachments are otherwise prohibited under standard NFIP floodplain management criteria. The certification typically requires hydraulic modeling (existing vs. proposed conditions) sealed by a licensed engineer and is submitted to the local floodplain administrator as part of the development permit application; some jurisdictions also require FEMA notification or concurrence depending on the scale of the encroachment.
Practically, a no-rise certification is one of the more schedule-sensitive deliverables on a floodplain-adjacent site — the hydraulic model has to reflect the actual proposed grading, so it can't be finalized until the site design is essentially locked, which pushes it late into design when teams have compressed the review runway.
When do you need a CLOMR or LOMR instead of, or in addition to, a development permit?
A floodplain development permit authorizes you to build within the floodplain as currently mapped. It does not change the map. If your project will actually alter the floodplain — for example, by adding fill that removes land from the SFHA, or by re-grading a channel such that the effective floodway or base flood elevations shift — you need FEMA to revise its mapping through a Conditional Letter of Map Revision (CLOMR) before construction and a Letter of Map Revision (LOMR) after construction is complete:
- CLOMR — FEMA's conditional, pre-construction determination that a proposed project, if built as designed, would justify a map revision. It is effectively a pre-check; it does not itself revise the map or substitute for the local development permit.
- LOMR — the actual map revision, submitted after construction is complete with as-built data, confirming the project performed as modeled and the FIRM should be updated.
These run parallel to, not instead of, the local floodplain development permit — you still need the local permit to build, and you pursue the CLOMR/LOMR with FEMA to get the map itself changed once the work justifies it. Sequencing matters: many floodplain administrators will not issue the local permit for a floodplain-altering project until a CLOMR (or at least a completed hydraulic analysis supporting one) is in hand, since the permit decision depends on knowing what the post-construction flood conditions will actually be.
How does this work differently in unincorporated Texas county land versus inside a city?
Texas has historically had no statewide building code enforcement in unincorporated areas, which means floodplain administration in unincorporated county land depends entirely on whether that county has adopted a floodplain ordinance and appointed an administrator — most do, because NFIP participation is what keeps flood insurance available to property owners countywide, but the level of technical review capacity varies widely between a large metro county and a rural one. Inside an incorporated city, the city's own floodplain administrator — often housed within public works, engineering, or a dedicated floodplain management office — issues the permit, and city ordinances are frequently more stringent than the federal NFIP minimum (higher freeboard requirements above base flood elevation, for example). Always confirm which jurisdiction — city or county — actually has authority over the parcel before submitting; annexation history and extraterritorial jurisdiction (ETJ) boundaries can make this less obvious than it looks on a plat.
How does the floodplain permit sequence with other Texas site-civil approvals?
On a typical Texas land-development project touching a mapped floodplain, the floodplain development permit runs alongside — and often gates — your other approvals.
